1. Acceptance of Terms

By accessing or using the DentalGuard platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. DentalGuard is operated by The Dental Emergency Room, a Minnesota dental practice established in 2008.

2. Description of Services

DentalGuard provides emergency dental teleconsultation services connecting patients with licensed dentists via secure video consultations. Our services include:

  • 24/7 emergency video consultations with Minnesota-licensed dentists
  • Professional dental assessment and diagnosis
  • Clinical documentation and medical reports
  • Electronic prescriptions when medically appropriate
  • Follow-up care recommendations

Important: DentalGuard provides emergency-only services and does not replace comprehensive in-person dental examinations or routine dental care.

3. Eligibility

You must be at least 18 years old to use DentalGuard services. If you are under 18, a parent or legal guardian must consent to these terms and supervise your use of the platform.

4. User Account

To use DentalGuard, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Fees and Payment

DentalGuard operates on a cash-pay model. Fees are clearly displayed before payment and must be paid prior to consultation. We do not accept insurance or process insurance claims. All payments are processed securely through PCI DSS-compliant systems.

Refund Policy: Refunds may be provided at our discretion if services cannot be rendered due to technical issues or if the dentist determines your condition cannot be appropriately addressed via teleconsultation.

6. Medical Disclaimer and Limitations

Emergency Services: DentalGuard is for emergency dental consultations only. If you are experiencing a life-threatening emergency, call 911 immediately.

Not a Replacement: Our teleconsultation services do not replace comprehensive in-person dental examinations, routine care, or emergency room visits when necessary.

Professional Judgment: Licensed dentists maintain full professional discretion in assessments, diagnoses, and treatment recommendations, including decisions regarding prescriptions.

Follow-Up Care: Patients are responsible for seeking appropriate follow-up in-person dental care as recommended by the consulting dentist.

7. Prescriptions and Pharmacy Services

When clinically appropriate, our licensed dentists may prescribe non-narcotic medications. DentalGuard does not prescribe controlled substances or narcotic medications through teleconsultation.

Prescriber Choice: Licensed dentists maintain full professional discretion in medication selection based on clinical assessment.

Patient Choice: Patients select their preferred pharmacy from our nationwide network for prescription delivery.

Pharmacy Network: Prescriptions are transmitted electronically through secure, HIPAA-compliant channels to participating pharmacies.

8. Privacy and Data Security

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal and health information. DentalGuard is fully HIPAA-compliant and uses end-to-end encryption for all communications.

9. Consent to Treatment

By using DentalGuard services, you consent to:

  • Receiving emergency dental consultation via telehealth
  • Video recording of consultations for quality assurance and record-keeping
  • Electronic transmission of prescriptions to your selected pharmacy
  • Storage of your medical records in our HIPAA-compliant system

10. Technical Requirements

You are responsible for ensuring you have the necessary equipment and internet connection to use DentalGuard services, including a device with camera and microphone capabilities.

11. Prohibited Uses

You may not use DentalGuard to:

  • Seek prescriptions for controlled substances or narcotics
  • Provide false or misleading information
  • Abuse, harass, or threaten healthcare providers
  • Use services for non-emergency or routine dental care
  • Violate any applicable laws or regulations

12. Limitation of Liability

To the fullest extent permitted by law, DentalGuard and The Dental Emergency Room shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

13. Governing Law

These Terms of Service are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of DentalGuard after changes constitutes acceptance of the modified terms.
